Terms and Conditions

1. Scope of Application

These terms and conditions apply to contracts for the rental of the holiday villas “Villa Aliara Panorama” for accommodation purposes and to all additional services offered by the landlord.

Subletting or onward letting of the villas, as well as use for purposes other than residential use, requires prior written consent of the landlord.

By booking, the guest accepts these terms and conditions as well as the house, pool, and jacuzzi rules.

2. Booking and Contract Conclusion

Bookings are made via the website, booking portals, or in writing by email.

The rental contract is concluded upon receipt of written booking confirmation and payment of the agreed deposit.

The guest is obliged to check the booking confirmation immediately for correctness and to report deviations within 48 hours.

3. Payment Terms

Within 10 days after receiving booking confirmation, a deposit of 20% of the total rental price must be paid.

The remaining payment is due no later than 30 days before arrival to the account specified by the landlord.

For bookings made within 30 days before arrival, the full amount is due immediately.

Security deposit: A security deposit of EUR 500.00 must be provided for each booked villa.

The deposit secures possible damage to the building, inventory, pool, jacuzzi, outdoor areas, and other facilities, as well as extraordinary cleaning costs.

Refund is made within 14 days after departure to the account specified by the tenant, provided no damage or additional costs are identified.

The landlord is entitled to offset justified claims for damages, cleaning, or other claims against the deposit.

In case of payment default, reminder fees of EUR 15.00 per reminder are charged.

Bank and transaction fees are borne by the guest.

Only bank transfer payments are accepted. Cash payments on site are possible by prior arrangement. Credit card, EC card, and check payments are not accepted.

4. Arrival and Departure

The villa is available from 3:00 PM on arrival day.

On departure day, the villa must be vacated by 10:00 AM at the latest.

Different times require prior approval of the landlord.

If departure is delayed by more than 60 minutes, an additional daily rate may be charged.

5. Stay and Use

Use of the villa is permitted only to persons specified in the booking.

Maximum occupancy: Villa Aliara Panorama 1 max. 8 persons; Villa Aliara Panorama 2 max. 10 persons.

The number of persons specified in the booking confirmation may not be exceeded. Additional persons may stay on the property or in the villas only with prior written consent of the landlord.

If the agreed number of persons is exceeded, the landlord may charge an additional reasonable fee per extra person and night or terminate the rental without notice.

Events, parties, weddings, birthday celebrations, corporate events, bachelor parties, or similar events are only permitted with prior written consent of the landlord.

Unregistered visitors may only stay on the property with the landlord’s consent.

Subletting or transfer to third parties is not permitted.

In case of violations of the house rules or these terms, the landlord is entitled to terminate the rental without notice. Refund of amounts already paid is excluded.

6. Condition of Property and Tenant Liability

The villa is handed over in cleaned and proper condition.

Defects must be reported to the landlord immediately.

The tenant is liable for all damage caused by the tenant or co-travelers to the building, inventory, pool, jacuzzi, outdoor areas, and technical systems.

Caused damages must be reported immediately.

In case of loss of keys or electronic access media, the guest is liable for all replacement and consequential costs.

Upon request, the guest must provide the landlord with details of liability insurance.

7. Pool and Jacuzzi Use

Use of the pool and jacuzzi is at own risk.

Children may use pool and jacuzzi only under constant supervision of an adult person.

Jumping from the pool edge and improper use are prohibited.

Glass bottles and glass containers are not allowed in pool and jacuzzi areas.

Bringing pets into pool or jacuzzi is prohibited.

In case of extraordinary contamination or damage to pool or jacuzzi systems, actual cleaning and/or repair costs will be charged.

8. Pets

Pets are permitted only with prior written consent of the landlord.

In case of unauthorized keeping of pets, the landlord may charge special cleaning fees or terminate the rental contract without notice.

Additional cleaning or repair costs caused by pets are borne by the tenant.

9. Quiet Hours and Noise Protection

In the interest of neighbors and all guests, quiet hours apply across the entire property from 10:00 PM to 8:00 AM.

During this period, the following are prohibited in particular:

• •loud music
• •parties and events in outdoor areas
• •loud conversations and gatherings in pool, jacuzzi, or terrace areas
• •other disturbing noise emissions

10. Cancellation and Withdrawal by Guest

Cancellations must be made in writing.

The following cancellation fees apply:

• •up to 28 days before arrival: 20% of rental price
• •7 to 27 days before arrival: 50% of rental price
• •0 to 6 days before arrival or no-show: 90% of rental price

11. Withdrawal by Landlord

The landlord may withdraw from the contract if force majeure or unforeseeable circumstances make contract execution impossible.

In this case, payments already made are fully refunded.

Further claims, especially for damages, travel costs, or accommodation costs, are excluded.

12. Landlord Liability

The landlord is liable only for intent and gross negligence.

Liability for temporary failures of electricity, water, internet, air conditioning, pool technology, jacuzzi, wallbox, satellite reception, or other technical systems is excluded unless caused intentionally or by gross negligence.

For items brought by guests, the landlord is liable only within statutory provisions.

Use of pool, jacuzzi, terraces, stairs, balconies, and all outdoor areas is at own risk.

The landlord is not liable for accidents, injuries, or damages caused by improper use, insufficient supervision, or violation of house, pool, or jacuzzi rules.

Parents and supervising persons are fully liable for children and minor co-travelers.

13. WLAN Use

The landlord provides WLAN access during the stay.

The guest undertakes to use WLAN only in accordance with legal provisions.

Copyright violations, file sharing, criminal content, and abusive use are prohibited.

The landlord does not guarantee continuous availability of internet access.

The guest is liable for all legal violations caused via guest access.

14. Data Protection

Personal data required for booking processing is processed only in accordance with applicable data protection regulations and is not passed on to unauthorized third parties.

15. Written Form

Amendments or supplements to these terms require written form. Oral side agreements do not exist.

16. Severability Clause

Should individual provisions of these terms be wholly or partially invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by one that comes as close as possible to the economic purpose of the invalid provision.

17. Jurisdiction and Applicable Law

German law applies.

Where legally permissible, jurisdiction is agreed to be Mainz.
